Kōlea Sparkling Hop Water ‘Serve the Bird Sweepstakes’ Official Rules

Participation is limited to legal residents of the state of Hawaiʻi in the state of Hawaiʻi at time of entry. Void where prohibited.

1. Promotion period:

The Kōlea Sparkling Hop Water ‘Serve the Bird Sweepstakes’ (the “Sweepstakes” or “Promotion”) begins on January 1, 2026 at 12:00:00 AM Hawaiʻi Standard Time (“HST”) and ends on February 28, 2026 11:59 PM HST (the “Promotion Period”).

2. Eligibility:

The Sweepstakes is open only to legal residents of the state of Hawaiʻi in the state of Hawaiʻi at the time of entry. Employees, directors, officers and agents of Kailua Beverage Company (the “Sponsor”), any alcoholic beverage industry wholesalers, distributors or licensed retailers, their advertising and promotion agencies, and their respective parents, affiliates, and subsidiary companies (collectively “Released Parties”), and the immediate families (spouse and parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the same households, whether related or not, of the above, are not eligible to enter or win a prize. By participating in the Promotion, entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to this Promotion. This Sweepstakes is void outside of the state of Hawaiʻi, and wherever prohibited or restricted by law. This Promotion is subject to all applicable federal, state, and local laws and regulations. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. How to enter:

In store entry: Scan QR code located on available signage at participating locations.

Entry limit: There is a limit of one (1) entry into the Sweepstakes per entrant per day during the Entry Period. If more than one (1) entry is received from the same person, telephone number and/or email address in a day, only the first entry received that day may be considered valid. For purposes of these Official Rules, a “day” starts at 12:01:01 AM HST and ends at 11:59:59 PM HST on a calendar day.

4. Random drawing:

A random drawing will be conducted on or about March 2, 2026 from among all eligible entries received. The drawing will be conducted by Sponsor or Sponsor’s agent, whose decisions are final and binding. Odds of winning depend on the number of eligible entries received.

5. Winner notification:

Potential winners will be contacted by Sponsor or Sponsor’s agent via email or phone and will be required to respond to the notification within forty-eight (48) hours. Winners may be required to complete and return an affidavit of eligibility, release of liability, prize acceptance form, and where lawful, a publicity release. Winners may also be required to complete a W-9 tax form which will be used solely for tax reporting purposes (collectively “Documents”). All completed Documents must be returned within three (3) days (including Saturdays, Sundays, and holidays) of attempted delivery of the same. Failure to return required Documents or respond to a notification within the time specified or return of any prize/prize notification as undeliverable will result in disqualification without further notice and an alternate winner will be selected, time permitting. In the event a potential winner is deemed ineligible, fails to comply with the Official Rules or is unable to claim the prize as specified, the potential winner will be disqualified, and an alternate winner will be selected, time permitting. Upon prize forfeiture, no compensation will be given. Prize award is contingent on eligibility verification and potential winner completing and returning all required Documents. Only three (3) random drawings to select an alternate winner (if necessary) will be conducted, after which the applicable prize will remain unawarded.

6. Prize and approximate retail value (“ARV”):

One (1) prize is available to be won, consisting of the following:

• One (1) portable pickleball net system

• One (1) limited edition Kōlea branded pickleball paddle set

• One (1) Franklin X-40 outdoor pickleballs 6-pack neon

• One (1) limited edition Kōlea branded pickleball bag

Total estimated value of all prizes $740 USD. Winner will be solely responsible for any applicable federal, state, and local taxes, and any other expenses related to the acceptance and use of a prize not specified herein. The value of the prize is taxable as income and winners may receive an IRS form 1099 for the total value of the prize as stated herein. No substitutions, cash equivalents, or transfer of prize permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, except as otherwise provided herein if the advertised prize becomes unavailable. Prize may not be sold, bartered, or exchanged by winners. In no event will more than the stated number of prizes be awarded. Prize consists of only the items specifically listed as part of the prize. Sponsor makes no warranties, and hereby disclaims any and all warranties, expressed or implied, concerning any prize furnished by third parties in connection with the Sweepstakes. All details of prizes not specified herein shall be determined solely by Sponsor.

7. Release:

Entrants/winners agree to release, discharge and hold harmless Released Parties and their respective successors and assigns from and against any claim or cause of action or liability (including but not limited to personal injury, death or damage to or loss of property) arising out of participation in the Sweepstakes or acceptance/receipt/travel to and/or from prize supplier location and/or participation/use or misuse of the prize, or any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action. Prize winners shall bear all risk of loss or damage to the prize after it has been delivered/awarded and agree to be bound by the Official Rules and the decisions of the Sponsor and/or Sponsor’s representatives, which are final. Acceptance of a prize constitutes permission for the Sponsor and its agencies to use winners’ name and/or likeness for purposes of advertising and trade without further compensation, including a winners list, unless prohibited by law. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the Promotion or in the announcement of prizes.

8. Notice:

Any attempt by an individual to deliberately corrupt the Promotion or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by law. Released Parties are not responsible for faulty, incorrect/inaccurate, undeliverable or mistranscribed entry information, incorrect announcements of any kind, technical hardware or software failures of any kind regardless of cause, including any injury or damage to any person’s mobile device/computer related to or resulting from participating in or experiencing any materials in connection with the Promotion; or lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in the Promotion. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s internet service provider and/or e-mail client or for insufficient space in user’s e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the Promotion if for any reason the Sweepstakes is undermined by any event beyond the Sponsor’s control, including but not limited to fire, flood, epidemic/pandemic, labor dispute or strike, act of God or public enemy, or any force majeure event or if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, unauthorized intervention or other technical problem corrupts the administration or security of the Promotion as determined by Sponsor/its agencies, in their sole discretion. In the event of termination, a drawing to award prizes will be conducted from among all eligible entries received prior to termination. The failure of the Released Parties to comply with any provision of these Official Rules due to an act of God, epidemic/pandemic, act of public enemies or any act outside of the Sponsor’s control/force majeure event will not be considered a breach of these Official Rules. In the event a dispute arises regarding the identity of a text message entrant, entry will be deemed made by the person who is the authorized account holder of the mobile phone used to submit the entry. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any entries which are suspected of being fraudulent (including those using robotic, automatic, programmed, or similar methods of participation) will be disqualified, based on determinations made solely by Sponsor. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

9. Choice of law and jurisdiction:

All questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with this Promotion, will be governed by and construed in accordance with the laws of the state of Hawaiʻi without regard to its choice of laws or conflict of law provisions. Claims may not be resolved through any form of class action. By participating, entrants irrevocably consent to the exclusive jurisdiction of the federal and state courts of Hawaiʻi for any action, suit or proceeding arising out of or relating to this Promotion. Entrant agrees that any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including any costs associated with participation in this Promotion but in no event attorneys’ fees; and under no circumstances will entrants/winners be permitted to obtain awards for, and entrants/winners hereby waive all rights to claim, punitive, incidental and consequential damages or any other damages other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

10. Privacy:

Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Sweepstakes for the purposes of administering the Sweepstakes and prize fulfillment. By participating in this Sweepstakes, entrants consent to such collection, use, and disclosure of personal information. Information collected from participants is subject to Sponsor’s privacy policy (https://www.koleahopwater.com/privacy-policy). Information collected from entrants (such as name, postal address, and email address) will not be re-used, sold, or shared in any manner by the Sponsor or any third parties unless entrant has opted-in to receive additional information and marketing or promotional material from the Sponsor or a third party.
